GENERAL TERMS AND CONDITIONS OF USE

1. AGREEMENT TO ACCEPT TERMS AND CONDITIONS

The terms and conditions of use set out below (“Terms and Conditions”) govern the use of this website, including but not limited to online donations, subscriptions and services provided through the SGI Canada Online Portal at https://sgicinfo.org/portal/login (hereafter referred to as the “Portal”). The Portal is the property of the Soka Gakkai International Association of Canada Association de la Soka Gakkai Internationale du Canada (“SGI Canada”). Throughout the Terms and Conditions, “you”, “your” or “user” refer to the person or entity who registers, access or uses the Portal.

By registering, accessing and/or making use of the Portal, you agree, on your own behalf and on behalf of any entity, organization, association, group in whatever form and wherever located on whose behalf you may be acting, to be bound by the Terms and Conditions. If you do not wish to be bound by the Terms and Conditions, do not register, access or otherwise use the Portal. You may not register, access and/or use the Portal unless you agree to abide by all parts of the Terms and Conditions. For disclosure information regarding subscriptions to SGI Publications through the Portal, see Section 7.

For greater certainty, a copy of the Terms and Conditions will be available for future access and printing through a link sent to the electronic mail address provided by you upon registration in the Portal.

2. REGISTRATION

The Portal is available to SGI Canada adult practitioners 19 years of age and over, residing in Canada only. In order to access certain resource materials and to receive services available on the Portal, you may be required to register and/or set up an account and select and register a unique user name and password. You may be asked to provide your name, date of birth, e-mail address, mailing address, place of residence and other personal information about you or that can be used to identify you (“Personal Information”) in order to register and/or set up an account on the Portal. SGI Canada may use your Personal Information, to verify your identity and to determine your age. When you register, you agree to provide accurate, current and complete Personal Information and to promptly update this Personal Information to keep it accurate, current and complete. You may not provide any false information to the Portal, or create an account for anyone other than yourself. You may only create one account on the Portal. If you select a username or similar identifier for your Portal account, SGI Canada reserves the right to remove or reclaim it if we believe it is appropriate.

Persons under the age of 19 are not permitted to register and/or set up an account on the Portal.  We do not knowingly collect the Personal Information of any person under the age of 19.

If you wish to make changes to the personal information on your profile, including deactivation or deletion of your account, please CONTACT US.

3. YOUR RESPONSBILITY FOR THE SECURITY OF YOUR PASSWORD

You are entirely responsible for maintaining the confidentiality of the user name and password that you are given or select in relation to your account and you are responsible for all activities carried out under your account if you fail to keep this information secure and confidential. You will not permit any other person to use your user name and password, and you will immediately notify SGI Canada if you know or suspect that your user name and password have been used by another person. SGI Canada has the right to suspend or terminate your account or other registration without notice to you if it suspects that the Personal Information you have provided is inaccurate. You may be held liable for losses incurred by SGI Canada or any other user of or visitor to the Portal due to someone else using your account as a result of your failing to keep your account information secure and confidential. You agree to immediately notify SGI Canada of any unauthorized use of your user name or password or any other breach of security.

4. PRIVACY AND CONSENT

In addition to these Terms and Conditions, your use of the Portal is also governed by SGI Canada’s Privacy Policy (“Privacy Policy”), which is available at https://sgicinfo.org/portal/privacy.  The Privacy Policy sets out the types of Personal Information SGI Canada collects, how it uses Personal Information, which third parties it may disclose Personal Information to and your rights in relation to your Personal Information.

SGI Canada is committed to protecting the privacy of registered users of the Portal and all practitioners whose Personal Information is submitted through the Portal.

By accessing and using the Portal, you agree and consent to the collection, use and storage of your Personal Information, including record of donations and any interactions with the Portal, in accordance with the Privacy Policy. You also agree and consent to the collection, use and storage of your Personal Information in accordance with the terms of service and privacy policies of SGI Canada’s third party service providers, including Korax Inc. (available here and here) and Microsoft (available here and here), for purposes of the operation and management of the Portal and SGI Canada’s customer relationship management system. If you do not consent to the practices outlined in the Privacy Policy and in the terms of service and privacy policies of SGI Canada’s third party service providers, you should not access or use the Portal.

The Portal is provided for practitioners of SGI Canada who reside in Canada only. Although it may be possible to access the Portal from other countries, we make no representation that the Portal is compliant with any legal requirements in force in any jurisdiction other than Canada, or that the content available on the Portal will be appropriate for users in other countries. SGI Canada operates within, is subject to and complies with Canadian privacy law.  SGI Canada is not established in the European Union (“EU”), does not offer goods or services to individuals in the EU and does not knowingly monitor the behaviour of individuals in the EU.  SGI Canada does not knowingly collect or process Personal Information from individuals located in the EU.  Individuals located in the EU should not register for an account on the Portal or provide us with any Personal Information

5. ONLINE DONATIONS

Donations made through the Portal are made to Soka Gakkai International Association of Canada, a charity registered with the Canada Revenue Agency (Registration No. 129849899RR0001). Donations through the Portal may be single one-time donations or pre-authorized recurring donations (e.g., monthly donations). You understand and agree that your personal information and payment instructions for donations made through the Portal are processed and managed by SGI Canada’s third-party payment service provider Stripe Payments Canada, Ltd. in accordance with such provider’s Services Agreement, Payment Terms and Privacy Policy (as amended from time to time and available here). The official donation receipt for tax purposes for all donations made by you in any given calendar year will be available for download before the end of February of the following year. Donations made through the Portal are unrestricted and may be used at the discretion of SGI Canada where needed most. You accept these terms and agree to be responsible for ensuring that your Personal Information includes complete and accurate billing and financial information.

SGI Canada follows Canada Revenue Agency (“CRA”) guidelines for donation refunds and does not perform refunds of donations except under extenuating circumstances that are deemed appropriate at the discretion of SGI Canada and in accordance with CRA policies and other applicable laws.

6. ONLINE SUBSCRIPTIONS

SGI Canada offers practitioners a variety of publications providing guidance and encouragement (i.e., New Century; SOKA, From Today Onward; Ère nouvelle; and Chinese New Century) (the “SGI Publications”). For an itemized list of the prices for SGI Publications, including taxes and shipping charges, see here.

To the extent that SGI Canada enables you to subscribe to SGI Publications by filling out and submitting the web-based form available through the Portal, you understand and agree that your personal information and payment instructions are processed and managed by SGI Canada’s third-party payment service provider Stripe Payments Canada, Ltd.in accordance with such provider’s Services Agreement, Payment Terms and Privacy Policy (as amended from time to time and available here). The payment for each subscription is charged on a monthly/annual basis (as selected by you) and may be cancelled by either you or SGI Canada at any time and without cost or penalty.

SGI Publications are delivered in print by mail to the address provided in the subscription form. The same SGI Publications are also available to subscribers for online viewing through the Portal.

7. CHANGES TO TERMS AND CONDITIONS

SGI Canada reserves the right to add to or remove, modify or otherwise change any part of the Terms and Conditions at any time in its sole discretion. Changes will be effective when the changed Terms and Conditions are posted on the Portal. You should check the Terms and Conditions frequently for changes by checking the date of “Last Update” at the top of this document. If any change to the Terms and Conditions is not acceptable to you, you should discontinue your use of the Portal immediately. Your continued use of the Portal after changes to the Terms and Conditions are posted will constitute acceptance of the changes.

8. CHANGES TO THE PORTAL

SGI Canada may terminate, change, suspend or discontinue any aspect of the Portal at any time without notice. Without limiting the generality of the foregoing, SGI Canada may change the availability of any features, institute new, or change existing fees or charges for the use of the Portal or any features thereof, add, remove, modify or otherwise change any contents on the Portal, impose limits on certain features or restrict access to parts or all of the Portal. SGI Canada reserves the right, but not the duty, to correct any errors or omissions in any portion of the Portal at any time without notice.

9. PROHIBITED ACTIVITIES

You may not use the Portal, any contents of the Portal or any information provided or accessed through the Portal to take any action that could harm SGI Canada or anyone else, interfere with the Portal, or use the Portal in a manner that violates any law. For example, you may not:

If SGI Canada determines, in its sole discretion, that you have engaged in any prohibited activities or have otherwise failed to comply with these Terms and Conditions, SGI Canada may suspend or terminate your use or access to the Portal without notice to you. At all times, SGI Canada shall have the discretion to take such action as it deems necessary, in its sole discretion, to preclude a violation, and SGI Canada shall not be liable for any damages of any nature suffered by you or a third party resulting from SGI Canada actions under these Terms and Conditions.

10. OWNERSHIP AND USAGE

All content, code, software, and any other materials that are on the Portal, including the SGI Publications and all other intellectual property (collectively, the “Intellectual Property”) are owned by or licensed to SGI Canada and are the exclusive property of SGI Canada or its licensors, unless otherwise indicated.

The Intellectual Property may not be copied, transmitted, transcribed, reproduced, stored, sub-licensed, re-posted or translated into any other form without the prior written permission of SGI Canada. Notwithstanding the above, you may display the Intellectual Property on your computer and print copies of the Intellectual Property only for non-commercial, informational, personal use, without modification, and only as long as you comply with these Terms and Conditions. 

No other use of the Intellectual Property is permitted without the express written approval of SGI Canada. Without restricting the generality of the foregoing, you may not make commercial use of the Intellectual Property, include the Intellectual Property in or with any product, service or content that you create or distribute, represent the Intellectual Property as your own, or copy the Intellectual Property onto your own or another’s website.

Some of the content on the Portal may be subject to the copyright of another source. There may be additional restrictions on the reproduction of such content.

The “look and feel”, selection, design, and arrangement of content on the Portal are owned by SGI Canada and its suppliers, and are protected by applicable laws, including copyright and industrial design.

11. TRADEMARKS

All trademarks displayed on the Portal including but not limited to “SGI Canada”, “Soka Gakkai International Association of Canada”, “SGI Publications”, the Portal’s domain name, and any related names, words, and logos displayed on the Portal, are trademarks owned by SGI Canada. You may not use any of these trademarks, or any variations of the trademarks.

All other trademarks not owned by SGI Canada are the property of their respective owners. You are not authorized to use any of those trademarks of third parties that may appear on the Portal.

12. HYPERLINKING AGREEMENT

If you want to hyperlink to the Portal, you may do so, provided you agree to the hyperlink conditions described below (“Hyperlink Conditions”):

  1. A hyperlink may be established to the following page of the Portal: https://sgicinfo.org/portal/login. Hyperlink may not be established to any other pages on the Portal without the prior written permission of SGI Canada.
  2. If you hyperlink to the Portal, your website or social media page,
    1. shall not imply that SGI Canada is endorsing you or your products or services;
    2. shall not imply an affiliation between you or any entity on whose behalf you may be acting without the prior written consent of the SGI Canada;
    3. shall not misrepresent your relationship with SGI Canada or present false or misleading impressions about SGI Canada or its services; and
    4. shall not contain content that may be interpreted as distasteful or offensive.
  3. SGI Canada shall have no responsibility or liability for any content appearing on your website.
  4. SGI Canada may at any time, in its sole discretion, immediately terminate your right to hyperlink to the Portal, with or without cause. If SGI Canada exercises this right, you will immediately remove all hyperlinks to the Portal.
  5. SGI Canada may amend these Hyperlink Conditions at any time. You agree to abide by these Hyperlink Conditions and the other Terms and Conditions on the Portal, as amended from time to time.

By establishing a hyperlink to the Portal, you will be deemed to have agreed to these Hyperlink Conditions.

13. WEBSITES HYPERLINKED TO THE PORTAL

SGI Canada is not responsible for the contents of any third party websites which hyperlink to the Portal without permission from SGI Canada. SGI Canada makes no representations or warranties, and does not endorse, any website that is hyperlinked to the Portal, the contents of any such website, the information appearing on any such website or any of the products or services described on any such website. The fact that a website is hyperlinked to the Portal does not imply that SGI Canada sponsors, endorses or is affiliated or associated with the entity that owns or is responsible for the website.

14. EXTERNAL HYPERLINKS

Certain hyperlinks on the Portal may take you to other websites. SGI Canada provides these hyperlinks only as a convenience. SGI Canada is not responsible for the contents of any hyperlinked website. SGI Canada makes no representations or warranties regarding, and does not endorse, any hyperlinked website, the contents thereof, the information appearing thereon or any of the products or services described thereon. Hyperlinks do not imply that SGI Canada sponsors, endorses or is affiliated or associated with the entity that owns or is responsible for any hyperlinked website. If you decide to visit any hyperlinked websites, you will do so at your own risk.

15. DISCLAIMER

Please read this provision carefully as it affects your legal rights. Any use of or reliance on the Portal, the contents of the Portal or the information provided through the Portal shall be at your sole risk. SGI Canada makes no representation or warranty of any kind regarding the Portal, the contents of the Portal or the information provided through the Portal, all of which are provided on an “AS IS” and “AS AVAILABLE” basis. SGI Canada expressly disclaims all representations, warranties, conditions and endorsements as to the operation of the Portal, the contents of the Portal or the information provided through the Portal. Without limiting the generality of the foregoing, SGI Canada makes no warranty as to the accuracy, quality or completeness of the contents of the Portal or information provided through the Portal, nor to merchantability or fitness for a particular purpose, nor to title or non-infringement, nor to the absence of any software virus, malware or other harmful component. SGI Canada does not warrant that the Portal or the delivery, hosting and ancillary services or facilities of third party suppliers utilized by SGI Canada will continue to operate, will operate without interruptions or will be error-free.

16. NO LIABILITY

Please read this provision carefully as it affects your legal rights. You, personally and on behalf of any personal representatives, understand and agree that in no circumstances shall SGI Canada, its affiliated organizations,  its partners and suppliers, its financial supporters and contributors, and their respective directors, officers, representatives, employees, agents, contractors, volunteers and successors or assigns  be responsible or liable to you for any loss, liabilities, claims, expenses or damages whatsoever, including (without limiting the generality of the foregoing) any direct, indirect, incidental, special, punitive, exemplary or consequential damages (hereafter collectively referred to as “Claims”), arising from or in connection with your use of, access to or your reliance on, or your inability to use or access, the Portal, any contents of the Portal, any information provided through the Portal, any external hyperlinks on the Portal, any website hyperlinked to the Portal, or any contents thereof, or any delivery, hosting and ancillary services or facilities of third party suppliers utilized by SGI Canada.

SGI Canada is not responsible and assumes no liability for third party contents of the Portal or third party information provided through the Portal.

You, personally and on behalf of any personal representatives, without limitation, agree to forever release and discharge SGI Canada and all persons and entities set out in this section from any and all Claims.

17. INDEMNITY

Please read this provision carefully as it affects your legal rights. You, personally and on behalf of any personal representatives, agree to indemnify, hold harmless and defend SGI Canada, its affiliated organizations, its partners and suppliers, its financial supporters and contributors, and their respective directors, officers, representatives, employees, agents, contractors, volunteers and successors and assigns from and against any and all liability, claims, suits, demands, actions, damages, losses, judgments and costs (including legal fees) arising out of or in connection with (i) your use of, access to or reliance on the Portal, or of any external hyperlinks on the Portal, any website hyperlinked to the Portal, or any contents thereof, (ii) your online conduct in connection with the Portal, (iii) your (or anyone acting under your username or password) violation or breach of these Terms and Conditions, (iv) your failure to comply with any applicable laws or regulations in connection with the Portal, or (v) your negligence, wilful misconduct, or violations of the intellectual property or other rights of any person in connection with the Portal. These obligations will survive any termination of these Terms and Conditions.

18. APPLICABLE LAW

The Portal is controlled by SGI Canada from its offices within the Province of Ontario in Canada. All matters relating to access to, or use of, the Portal shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein. In the event of any action or proceeding instituted under or related to the Portal, or the contents thereof, you consent and submit to the exclusive jurisdiction of the courts of competent jurisdiction in the City of Toronto, in the Province of Ontario. Use of the Portal is not authorized in any jurisdiction that does not give effect to all Terms and Conditions, including without limitation this section.

19. SEVERABILITY AND WAIVER

These Terms and Conditions and all other legal notices, statements or terms and conditions posted or made available to you in writing by SGI Canada constitute the entire agreement between you and SGI Canada. In the event any provision of these Terms and Conditions is held unenforceable, it will not affect the enforceability of the remaining provisions and will be replaced by an enforceable provision that comes closest to the intention underlying the unenforceable provision. The failure of SGI Canada to enforce any provisions of the Terms and Conditions or respond to a breach by you or other parties shall not in any way waive its right to enforce subsequently any Terms and Conditions or to act with respect to similar breaches.
